1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via our website. By purchasing our handcrafted biomaterial jewellery or booking online workshops, you agree to these terms and conditions.

3. Product Description

Our jewellery pieces are handcrafted art objects made from natural, bio-based materials. Due to the nature of these materials, slight variations in colour, shape and texture are characteristic of the process.

Each piece is designed to be durable yet sensitive; avoid prolonged contact with water, heat or sunlight.

4. Conclusion of Contract

The presentation of products on our website does not constitute a legally binding offer but an invitation to place an order. By submitting an order, you make a binding offer to purchase the goods. The contract is concluded after confirmation by email or dispatch of the goods.

5. Prices and Payment

All prices listed on the website are final prices and include the applicable statutory VAT in accordance with German law.

Shipping costs are not included in the product prices and are shown separately during the checkout process.

Payment is due immediately upon conclusion of the contract and can be made using the payment methods offered on the website.

VAT is shown separately on invoices and order confirmations where required by law.

6. Shipping and Delivery

We ship worldwide unless otherwise specified. Shipping costs are calculated at checkout and must be covered by the buyer.

Delivery times may vary depending on destination and production effort. We are not liable for delays caused by shipping providers or force majeure.

Non-EU Orders:
Orders shipped outside the European Union (e.g. to the UK, USA, or Switzerland) are treated as exports. German VAT may not be charged depending on the destination country.

Any local customs duties, import VAT, or additional charges imposed by the destination country are the buyer's responsibility.

7. Taxes & VAT / Steuern & Umsatzsteuer

AMAVSS* / Alicia Valdés Selbach is registered for VAT in Germany.

All prices shown on the website include the applicable German VAT (unless otherwise stated).

For deliveries outside the European Union, VAT treatment may vary depending on the country of destination. Any customs duties, import VAT, or additional charges are the buyer's responsibility.

8. Right of Withdrawal and Return Policy

Because all jewellery pieces are handcrafted and individually produced using natural biomaterials, they are considered custom-made items within the meaning of §312g para. 2 No. 1 BGB.

Therefore, the statutory 14-day right of withdrawal and return does not apply.
All sales are final.

If an item arrives damaged, please contact us within 7 days of receipt at biodesign@aliciavaldes.eu so we can assess a replacement or repair on a case-by-case basis.

9. Liability Disclaimer for Allergic Reactions

Our jewellery consists exclusively of natural materials. Individual allergic reactions can, however, not be excluded; we therefore assume no liability for incompatibilities or allergic reactions.

10. Warranty and Replacement for Breakage

If a biomaterial jewellery piece breaks within ten (10) months of purchase, we offer a one-time free replacement. After this period, no replacement can be guaranteed. The customer bears shipping costs for the replacement.

11. Warranty and Liability

Statutory warranty rights remain unaffected. Our liability for damages is excluded unless caused by intent or gross negligence.
This does not apply to injuries to life, body, or health, or in case of a breach of essential contractual obligations.

12. Data Protection

The processing of personal data is carried out in accordance with our privacy policy. By using our website and purchasing our products, you agree to the processing of your data under applicable data-protection laws.

13. Intellectual Property

All designs, images, and content on this website are protected by copyright.
Any reproduction or commercial use without our explicit consent is prohibited.

14. Changes to the Terms and Conditions

We reserve the right to change these terms and conditions at any time. The current version is available on this website.

15. Applicable Law and Jurisdiction

The law of the country in which our company is based applies. The place of jurisdiction for all disputes in connection with a purchase is the registered office of our company.
